Material Litigation (Cont’d) (ii) Shah Alam High Court Suit No. BA-28NCC-459-08/2024 Pursuant to the Petition, the wholly-owned subsidiary, Destini Armada Sdn. Bhd. (“DASB”) has allegedly failed to pay outstanding tax liabilities amounting to RM2,939,963.75, plus interest of RM177,360.89 and RM392,727.68 to Lembaga Hasil Dalam Negeri (LHDN) (“Petitioner”). The Petitioner prays for the following orders: (a) That Destini Armada be wound up by the Court under the provisions of Section 465(1)(e) of the Companies Act, 2016. (b) That the Official Receiver of Malaysia be appointed as the Official Liquidator of Destini Armada. (c) That the costs of the Petition be paid out of the assets of Destini Armada. A settlement proposal has been submitted to LHDN. The case management for e-review has been scheduled for 9 September 2024, and the hearing date has been fixed for 11 November 2024. The Government of Malaysia (LHDN) has withdrawn the case on 11 November 2024. No further legal action was taken by LHDN against Destini Armada Sdn. Bhd. in respect of the dispute. (iii) Letter of Demand from Linc Shared Services Sdn. Bhd. On 17 March 2026, the Company received a letter of demand from Linc Shared Services Sdn. Bhd. claiming a total sum of RM1,832,585.63, comprising RM1,620,306.04 being the principal sum for services rendered under a service agreement and RM212,279.59 being late payment interest. The Company replied on 16 April 2026 to request for the supporting reports and evidence of the services claimed. As at the date of this report, no writ of summons has been served on the Company. The principal sum of RM1,620,306.04 has been accrued in trade and other payables. No provision has been recognised for the late payment interest of RM212,279.59 as the Directors are of the view that an outflow of resources is possible but not probable.
